Part 1 will consist of a discussion of the requirements of Rules 1.1 [Comment 8], 1.4, 1.6, 1.15 and 5.3 of the Ohio Rules of Professional Conduct as they implicate technological competence, communication and handling of confidential information. ABA Formal Opinions 477 (May 11, 2017) and 483 (October 17, 2018) will be addressed, as will the implications of Ohio Revised Code Section 1349.19 for lawyers.
Part 2 will consist of a discussion by bankruptcy court staff describing problems observed by them involving potential client data security issues for practitioners in the court and suggested best practices for being alert to and avoiding them.
Part 3 will consists of an overview of cybersecurity insurance for lawyers.

JUDGE MARY ANN WHIPPLE
Mary Ann Whipple is in her second term as a United States Bankruptcy Judge for the
Northern District of Ohio, Western Division, at Toledo. The United States Court of Appeals for the
Sixth Circuit initially appointed Judge Whipple on May 1, 2001. She also served a four year term
as a member of the Sixth Circuit Bankruptcy Appellate Panel.
Born in Ann Arbor, Michigan, Judge Whipple grew up in Toledo and is a graduate of
Thomas A. DeVilbiss High School. Judge Whipple graduated from the University of Michigan in
1977 with an A.B. degree in Russian Studies and from Stanford Law School in 1981. Before being
appointed as a bankruptcy judge, she practiced law for twenty years as a commercial, bankruptcy
and employment litigator with the Toledo firm Fuller & Henry Ltd. Judge Whipple taught
Creditor/Debtor Law for many years as a part-time faculty member at the University of Toledo
College of Law.
Judge Whipple has served her community as a member of the boards of trustees of the
Owens Community College Foundation, American Red Cross-Greater Toledo Area Chapter, the
Lucas County Mental Health Board, the Toledo Area Chamber of Commerce, Family Service of
Northwest Ohio and the University of Michigan Club of Greater Toledo. Judge Whipple received
The Toledo Bar Association’s 2008 Community Service Award and the Toledo Women’s Bar
Association’s 2016 Arabella Babb Mansfield Award. She is a master in and a past president of The
Morrison R. Waite Chapter of the American Inns of Court Foundation.
